Class1 terms of service
Terms and conditions for using the Class1 estimation engine.
What do these terms cover?
These terms cover your use of the Class1 pre-merge cost estimation engine, the class1.dev website and the browser sandbox estimator. The central point is that Class1 produces forecasts, not invoices: every number is a Monte Carlo estimate against a frozen, effective-dated rate basis, and your actual provider bill is the only authoritative record of what was charged.
Acceptance of terms
By using Class1, you agree to these terms.
By installing the Class1 GitHub App or executing the abc7d engine, you agree to these terms. If you are accepting on behalf of an employer or another organisation, you confirm that you have authority to bind that organisation, and "you" includes it.
These terms apply from the moment you install, execute or evaluate the engine. Continued use after a change to these terms constitutes acceptance of the revised version. If you do not accept them, do not use the engine and contact us to close the arrangement.
Service level and estimates
Class1 provides estimates, not guarantees.
Class1 provides cost estimates based on Monte Carlo simulations and historical calibration. Each report states a distribution rather than a point value: P50 as the central estimate, P90 as the tail a budget owner should approve against, and P95 as the stricter ceiling. We do not guarantee exact bills. The variance between our P90 forecast and your actual cloud invoice does not constitute a breach of service.
Estimates depend on inputs you supply or that the scanner infers from a diff: request volume, context length, model selection, retry counts, fallback routes and cache behaviour. When those inputs do not match production reality, the estimate is wrong in the same direction as the error. Class1 mitigates this by refusing to present false precision: the estimate class on every report states how much evidence stands behind the number, and it only improves as post-merge actuals accumulate.
Rate data is a frozen snapshot with an effective date and a recorded source per model. Providers change prices, introduce tiered rates above context thresholds, and retire models. Class1 reproduces the estimate it made at the time; it does not restate history when a provider later changes its rate card.
License
The engine is source-available, not open-core.
The core abc7d engine is source-available under the Business Source License 1.1 (see the LICENSE file in the repository) - it is not an open-source or open-core license. The License lets you view, use, and modify the source subject to its terms. Certain production and enterprise uses, including blocking budget gates and automated actuals ingestion, require a commercial license key.
The License's Additional Use Grant is explicit about the advisory case: running the non-blocking advisory report in CI is permitted without a commercial key, including on a company's private repositories and on repositories that are part of a commercial product. It becomes a licensed production use only when the output gates a merge, a deployment or a budget, or when the estimate/actual store is kept as a persistent production calibration database.
A commercial license key is issued per deployment and may be validated at runtime. Keys are not transferable between organisations, and the key material in any published fixture is intentionally burned and unusable. Circumventing license validation is a breach of these terms as well as a breach of the License itself.
Acceptable use
What you may not do with the engine.
Do not use Class1 to probe, scan or load third-party systems without authorisation. The engine is designed for repositories you own or administer. Do not submit proprietary code from an employer to any deployment you are not authorised to use, and do not attempt to remove or obscure attribution in reports you share externally.
Do not present a Class1 P50 or P90 figure as a guaranteed budget, a fixed-price quote, or a substitute for your provider contract. The estimate is an engineering input to a decision, and the decision and its consequences remain yours.
Intellectual property
Who owns what.
Class1, its authors and its licensors retain all rights in the engine, its documentation, the site content and the rate basis. You retain all rights in your code, your data and your actual usage records. Access to the engine grants no right to the Class1 name or marks beyond describing the tool you already use.
Aggregate, non-identifying usage telemetry is not collected by the public site. A private-repository pilot is governed by a separate written agreement that states exactly which execution metadata is retained and for how long.
Liability
Estimates carry inherent uncertainty.
Class1 is not liable for cost overruns resulting from inaccurate estimates, configuration errors, or changes in third-party pricing structures. To the extent permitted by law, our aggregate liability arising from your use of the engine or the site is limited to the amount you paid Class1 in the 12 months preceding the claim, and we are not liable for indirect, incidental or consequential loss including lost profit or lost data.
Nothing in these terms excludes liability that cannot be excluded under applicable law, including statutory consumer rights. Estimates are a decision aid; the responsibility for a production budget, and for the consequences of approving one, stays with your organisation.
Changes and termination
How these terms evolve.
We may revise these terms as the product changes. Material revisions are announced on this page with an updated date, and the revision applies from that date forward. Continuing to use the engine after a revision means accepting it.
You may stop using the engine at any time. A commercial license may be terminated for non-payment, for a material breach that is not cured within 30 days of written notice, or immediately where continued use would breach a third-party right. On termination the licence to use the engine ends, and you should remove the GitHub App and revoke its tokens.
